Please be aware that as of about 11:00 PM CDT on July 11th 2010 we have updated our firewall and security settings to provide greater security against direct attempts to exploit and breakin to the main hosting systems. Although we have not had this happen to any of our systems a security flaw was found on another non-ciritcal, non-business system which allowed a remote user to utilize the system for port scanning purposes. In light of this discovery we felt it necessary to review and update firewall settings immediately to ensure such an vunerability does not exist on our systems.

1. Pleiades Design will not provide any information, which You give us to any other organization or individual (with the exception of our direct business affiliates who we share common day-to-day business operations with and relate directly to keeping Your account functional) without Your express permission or legal compulsion such as a Court order.
2. As part of routine administration, Pleiades Design collects system status information such as login times and help desk records. These are not on-sold or disclosed to others except as required in paragraph 1.
3. All clients may request access to the personal details collected by Pleiades Design in relation to themselves and the use of the Account owned by them. Pleiades Design wishes to ensure that such details are always correct and up-to-date, and will amend any inaccuracies or changes to details on request.
5. Pleiades Design is constantly working to improve and enhance its Services to clients, and may update this privacy policy as required. Any changes to the policy will be advised to clients through notification via, post, e-mail, fax or/and by updating this page on the Pleiades Design web site.

Introduction
This document sets out the terms and conditions of Your Hosting Services with Pleiades Design. This document is available on request from Pleiades Design. This document may be modified from time to time, but any changes that are potentially detrimental to customers will be advised to all existing customers by email with 21 days (3 weeks) notice.
Definitions
In this document, certain words and phrases are defined for accuracy and certainty. Singular definitions include the plural and vice versa, where the meaning requires it.
Account means the Hosting Service chosen with Pleiades Design and defines the following:
(i) Connection speed (where and if applicable);
(ii) Pricing details (of the Setup Fee, Regular Payment, Excess Usage and Special Conditions);
(iii) Services to be provided;
(iv) Contract Period;
(v) Account Specification; and
(vi) Terms and Conditions.
Account Specification means any predefined limits on Hosting Services as outlined in Your Application Form and Contract arrangement.
Application or Application Form refers to the form containing:
(i) The Account holder details;
(ii) Payment details; and
(iii) The specific details of the Account, such as Services being provided.
In the event a specific Application or Application Form is not feasible or otherwise able to be completed easily an Invoice/Bill also serves this purpose.
Backup Hosting means the Service provided by Pleiades Design to You in order to store backup data on the Pleiades Design servers and network for the purpose of recovering this data in the event of an emergency or unexpected loss of data contained in the backup.
Bit means the smallest unit of information having just two possible values, as either of the binary digits 0 or 1.
Byte means a sequence of 8 bits.
Contract means the contract between Pleiades Design and You that comes into effect on acceptance by Pleiades Design of Your Application.
Customer see definition of "You".
Defined Abuse means misuse of Hosted Services or Internet Access as follows:
(i) Giving an unauthorized person Your Account and password details;
(ii) Deliberately or unintentionally disrupting Pleiades Design’s service, or engaging in any activity likely to disrupt Pleiades Design’s service;
(iii) Engaging in Spamming;
(iv) Misusing Hosted Services or Internet Access in a manner identified by a competent law enforcement official as unlawful such as copyright violations, defamation or fraud;
(v) Using Your Hosted Services or Internet Access to menace or harass others;
(vi) Denial-of-Service Attacks on other users or networks;
(vii) Using Your Hosted Services or Internet Access to unlawfully obtain access to other networks;
(viii)Using Your Hosted Services or Internet Access to make offensive, inappropriate or off-topic posts to Usenet News; or
(ix) Breaching any additional forms of abuse defined in the Special Conditions.
(x) Using any Service provided by Pleiades Design for the acquirement or distribution of inappropriate materials including but not limited to illegal pornography, illegal software, legal software being illegally distributed (warez), material and documents deemed as inappropriate, unethical, immoral or illegal by Pleiades Design or within any governing body jurisdiction to find afore mentioned data as such.
Denial-of-Service Attacks means behavior that results in disruption of Pleiades Design’s Service(s), and/or the ability for Pleiades Design to provide such Services, disruption of other people's Internet Access, disruption of Services or connectivity to or provided by other entities, and attacks which include but are not limited to computer viruses, connection flooding, email bombardment and damage to Internet-connected resources.
Domain Name means the registered name for a web address. A domain name needs to be registered, delegated and hosted for it to be easily accessible via the World Wide Web and Internet.
Downtime means periods of unavailability or limited availability of Internet Access and could include inaccessibility to Hosted Services being provided by Pleiades Design.
Excess Usage Charges means the Fees for the Usage over and above the allocated Monthly Usage or those specified in Your Contract.
Fee means a sum charged by Pleiades Design to You.
FTP Hosting means the Service provided by Pleiades Design to You in order to store and retrieve files through use of the File Transfer Protocol (FTP).
Game Hosting means the Service provided by Pleiades Design to You in order to store and retrieve files related to, maintain and run an Internet gaming server. Examples of this include but are not limited to Quake, Half-Life, Fire Arms, Counterstrike, and other applicable games.
Gigabyte (GB) means one billion bytes.
Pleiades Design, Us, and Our means Pleiades Design of 11725 Melrose, Overland Park, KS 66210, United States of America and Affiliated Businesses. Hosting Service(s), Hosted Service(s) and Service(s) means the services provided by Pleiades Design, which include but are not limited to Website, Data/FTP, Backup, IRC, Streaming Media and MUD/Game Hosting.
Internet Access means connection to the global network of networks known as "The Internet" using software protocols supported by Your or our Internet Service Provider (ISP) to connect computer equipment to the ISPs network. This includes access to email and the World Wide Web and other related services.
Internet Relay Chat (IRC) and IRC Hosting refers to the Internet Relay Chat protocol used as a method of communication through "The Internet" and a way to socialize with other users. IRC Hosting refers to the Service provided through Pleiades Design to You in order to store and retrieve files related to, maintain and operate an IRC server.
Open Third-Party Mail Relay means the use of a mail server to process a mail message by an unauthorized person.
Megabyte (MB) means one million bytes.
Multi-User Dungeon (MUD) Hosting means the Service provided by Pleiades Design in order for You to store, retrieve, run and maintain a text-based gaming Service known generically by the definition name.
Payments Due means any invoiced amount issued to You by Pleiades Design arising under the Account or the Contract.
POP/IMAP email box refers to a username and password protected space where email for a specific email address is deposited. This mailbox and its contents are stored on Pleiades Design’s mail server and are accessed using the POP3 or IMAP protocols.
Provisioning means the time necessary to complete any work that is required for You to be able to access Hosting Services and the time necessary to remove those Services upon cancellation.
Regular Payment is the periodic Fee due to Pleiades Design from You for Your Internet Access, excluding Setup Fee, Excess Usage and Special Conditions.
Setup Fee refers to a once off Fee stated on the Application Form or Contract for Account setup.
Special Conditions means the terms and conditions endorsed on the Application Form, which impose fees, conditions and limitations on the provision of Internet Access and include the Account Specifications and any Special Term.
Spamming means unsolicited bulk electronic messages sent by You which in the reasonable opinion of Pleiades Design constitutes a breach of acceptable use of the Internet Access or Hosted Services.
Special Term means an additional Service provided by Pleiades Design at the standard rate endorsed on the Special Conditions on the Application Form.
Streaming Media Services and Hosting refers to a Service provided by Pleiades Design to You in order to provide either stored or live data to Your audience, website visitor, in some format via a mechanism designed for this transfer from Pleiades Designs’ systems as specified in Your Account.
Sub-domain refers to a web address based on a domain such as ns4.pleiadesdesign.com, the ns4 designates this domain as a sub-domain of pleiadesdesign.com.
Suspension means the act of temporarily withdrawing Your Internet Access or Hosted Services.
Terminate means the process of Pleiades Design ceasing to provide Internet Access or Hosted Services.
Term Free specifies an account that has no penalties for cancellation. The Setup Fee is non-refundable except under exceptional circumstances and where required by law.
Traffic is all data that is inbound (IE. incoming to Your Internet connection), or outbound (i.e. outgoing from Your Internet connection) at all times. Traffic may take the form of emails, web requests and web data, File Transfer Protocol (FTP) uploads or downloads and other Services. If You are connected to the Internet, then You are using Traffic. The Account You have will determine how Your Traffic with Pleiades Design is counted and/or billed.
Usage means the measurement of time or data generated by Your Internet Access.
Usage Charged means any Account that is billed for Excess Usage, as described in the Account Specification section.
Universal Resource Locator or URL means a web page address.
Usenet News means the hierarchy of newsgroups providing public messages on a variety of topics.
Web Hit means a request for any file from the World Wide Web, including but not limited to any text, graphics, sound, animation or video file on any individual web page.
Web Space refers to the space allocated by Pleiades Design as a facility to store WebPages if supplied on Your plan.
Web Hosting means the Service provided by Pleiades Design as a method to store and display web pages and web based information to users over "The Internet".
World Wide Web refers to the collection of websites on the Internet beginning with “www”.
You and Your refer to the customer of Pleiades Design named in the Application Form, and includes any person using the Account with or without Pleiades Design’s permission.
Terms and Conditions
1.0 Service Agreements
1.1 Section 1.0 applies to all Accounts.
1.2 Pleiades Design agrees to provide You with Hosted Services under Your nominated Account for the Fees stated in the Application document.
1.3 Applications are accepted in person, by mail, electronic mail, web, and over the phone. When Pleiades Design accepts Your Application Form, the Contract is formed and You are bound to the Fees, Contract period, and this Standard Form of Agreement until either party terminates the Account in accordance with these Terms and Conditions.
1.4 Your Account is activated when Pleiades Design accepts and processes Your completed Application Form. Some Accounts require a Provisioning period and activation occurs when Provisioning is complete.
1.5 Pleiades Design will provide You with the required configuration information, Your username, password and access information (where applicable) for Your Hosted Services. You are responsible for all equipment and software necessary to access the Internet, including, but not limited to, a computer, modem and an active phone line or other connection method. For Hosted Services You are responsible for all files, maintenance, back-ups, security in order to utilize a Hosting Service, including, but not limited to, server daemon applications, Service and licensing agreements, and access to The Internet unless otherwise specified in Your Application.
1.6 You must use a secure password and ensure that this password is not disclosed to any unauthorized person. More information about passwords is available in the Passwords section below.
1.7 You are responsible for all use of Your Account. Due to the nature of virii and security situations Pleiades Design cannot and makes no official claim to protect You against computer viruses or other security problems. However, Pleiades Design does have software and methods in place that may assist with the prevention of virus infection and other exploits such as anti-virus software, firewalling, scan detection, password auditing, security auditing and verbose security logging. The afore mentioned options are subject to change, addition or removal without notice due to updates, upgrades, incompatibilities or other reasons unknown. Pleiades Design cannot control the material that is available on the global Internet. If You are confronted with material You believe to be illegal, You should report it to the appropriate authority.
1.8 Pleiades Design does not accept Accounts from persons under the age of 18. If You allow a minor to use Your Account then You are legally responsible for supervising their usage.
1.9 Pleiades Design will protect Your privacy and will ensure that Your full name, password, payment, personal, and contact details are not disclosed to non-account related third parties except as specifically required by law. Pleiades Design reserves the right to share Your information with its’ business affiliates associated with Your specific account management such as Your re-seller, if applicable, in order to conduct day-to-day business actions with Your Account. Pleiades Design’s privacy policy is available in the Privacy section below, and is available through request.
2.0 Network Agreements
2.1 Section 2.0 applies to all Accounts.
2.2 Pleiades Design makes all reasonable effort to provide You with Hosted Services that are always accessible and has a goal to provide at least 99% uptime. However, occasional scheduled maintenance and operational problems may result in some Services not being available. Pleiades Design will remedy any Service problems as soon as possible, but Pleiades Design is not liable for any loss You suffer because any part of the Internet Access is not working and has rendered Your Hosted Services inaccessible. Downtime will not be compensated unless otherwise stated in Your Account agreement or under circumstances in which Pleiades Design deems it appropriate to provide such compensation.
2.3 Connection speeds cannot be guaranteed, nor can Pleiades Design guarantee connection to any particular Internet site.
2.4 Network performance may vary among Accounts, and Pleiades Design may manage its’ network to ensure fair and equitable Usage.
2.5 Pleiades Design is not responsible for backup and storage of Your data and is not liable for any losses incurred as a result of this unless otherwise specified by Your Account, such as in a Backup Hosting package.
2.6 If the size of an email (including attachments) sent or addressed to You passing through our mail server exceeds 5 Mb, Pleiades Design’s mail server 'may' reject the message at Pleiades Design’s discretion.
2.7 If You run Your own mail server, it is Your responsibility to ensure it is not open for use as an Open Third-Party Mail Relay. In the event that Pleiades Design is notified of or detects an open mail relay from Your server, Pleiades Design reserves the right to suspend Services, block the port and related access until the Open Third-Party Mail Relay is closed.
3.0 Backup Hosting
3.1 Section 3.0 applies to only Backup Hosting Services.
3.2 Backup Services provided by Pleiades Design are provided for the storage of redundant data. This Service is not intended to be a primary source for data use and is “only” provided as a backup source.
3.2 Storage of regular day-to-day business files outside the purpose of ensuring recoverability in the event of original copy loss is strictly prohibited and accounts found to be out of compliance with Pleiades Design Backup Hosting policies will be subject to suspension until compliance can be assured or termination to be determined at Our discretion.
3.3 If You are found to be using the Backup Hosting Service to distribute files or use the Service in any other way than which it is intended You will be notified by e-mail, post, phone or other contact method and will be given 48 hours to comply with these Terms of Service or face account suspension or termination to be determined at Our discretion.
3.4 The Backup Hosting Service specifically provides the following to the Customer unless otherwise specified in Your Contract:
(i) Software or other means to back up necessary files to our servers.
(ii) The storage of those files for either a specified amount of time defined in the Contract by You or until available space allocated per Your Contract has been utilized to capacity.
(iii) Primary accessibility to these backups during normal business hours, from 8am to 5pm CST, Monday through Friday and Secondary access by advanced request at any other times.
(iv) Should an error, security breach or other problem arise that does or could impact Your prior, current or future backups, Pleiades Design will notify You within 24 hours and work to provide an alternate means to backup files or refund the current billing cycle’s Fee’s. To be decided at Our discretion.
3.5 Pleiades Design guarantees that files stored on our server(s) using this Service will be kept in highly secured, isolated and possibly encrypted areas of our server(s) in order to prevent access by unauthorized personnel and ensure data secrecy in the event of an unforeseen security breach and will provide a directory permissions audit upon request to demonstrate this security. If found to be out of compliance Pleiades Design will refund the previous and current billing cycle’s fee’s and offer You the ability to terminate any existing contract with Pleiades Design without any fee or early termination penalty.
3.6 We cannot guarantee the functionality of, or provide support for any backup software other than our own and due to this are unable to guarantee the integrity and reliability of any backups not provided through our software and set up by specifically authorized personnel and affiliates.
3.7 If software provided by Pleiades Design is installed and configured by authorized personnel, Pleiades Design asserts the guarantee that Your backups are functional and will be available upon request (per request specifications mentioned above in 3.4(iii)). If Pleiades Design fails to provide these backed up files as asserted at a time in which they are needed to restore Your system to a functional nature, Pleiades Design will refund Your Fee’s up to one year or the start date of Your Service, whichever is shorter, and release You from all contracted obligations as well as provide basic data recovery Services, within the abilities of Pleiades Design, to You free of cost provided by our authorized personnel in order to recover needed data where possible.
3.8 Pleiades Design reserves the right to perform random unannounced restore tests using Your backed up files to a secure location in order to ensure Your backups are functioning properly and are recoverable in the event You should need them. Pleiades Design also asserts that disk drives which are used for this purpose will be wiped using the DBAN drive erasure utility set at Department of Defense specifications to ensure no data restored through the test is present on the drive after the test is finished. Pleiades Design will inform You after such a test has been performed and completed.
4.0 Administration
4.1 Section 4.0 applies to all Accounts.
4.2 Pleiades Design offers some basic support but offers no guarantees regarding problem resolution. 4.3 All Internet related queries must go though Pleiades Design. Any communication or calls made to a third party that results in a charge levied against Pleiades Design may be billed to You.
4.4 You may notify us by post, facsimile or email. We may notify You by phone, post, facsimile or email.
4.5 Internet related and phone based computer repair, hosting, design and other advice from Pleiades Design’s staff is given in good faith but in these and related situations Pleiades Design does not necessarily represent that its staff are experts in the operation of Your specific computer hardware, software, hosting or setup and You must act on any advice given at Your own risk. Any software supplied with new Accounts has been provided in good faith by Pleiades Design and unless otherwise specified remains property of Pleiades Design of which ownership is not transferable and must be returned or removed upon termination of a Contract which granted software use. Pleiades Design is not aware of any defects in the provided software that may interfere with the operation of Your computer hardware or software. However prior to installing the software, You should verify that it is compatible with Your computer hardware and software. Pleiades Design does not warrant that the software will be compatible or defect free and You agree to install and use the software entirely at Your own risk.
4.6 Pleiades Design makes reasonable efforts to ensure that information on the Pleiades Design website is correct and up to date. However, Pleiades Design does not warrant the accuracy of that material. All information is subject to change without notice.
4.7 Pleiades Design may change Fees or conditions on 21 days notice (3 weeks). Pleiades Design will notify You if the proposed changes would be in any way detrimental to You.
4.8 If Pleiades Design is ever sold to another company, these terms will remain in force during any period of transfer and transition. The duration of this is to be announced at the public statement of the company’s sale.
5.0 Billing
5.1 Section 5.0 applies to all Accounts.
5.2 Fees commence from the date Your Account is active with Pleiades Design unless otherwise specified in Your Account agreement (this is the case with such accounts as Hosting Services and where payments specified in the contract may be due immediately, possibly prior to Services being instated).
5.3 All portions of Usage are billed for. Unused Usage monthly allocations are not transferable to consecutive months.
5.4 The Setup Fee is processed upon Account Activation and is non-refundable.
5.5 The Payment Due is payable in monthly, semi-annually or annual installments, depending on Your choice of Account. Pleiades Design will bill You at least 14 days before the Fee is due unless automatic withdrawal is chosen which will result in a withdrawal of funds from Your account on or just after Your billing date. Bills are sent by email in the form of an Invoice or by postal mail or fax if possible depending on which method is best for both Pleiades Design and You.
5.6 Usage Charges (where applicable) relating to Traffic are counted for Traffic that passes through to Hosting Services purchased by You.
5.7 You are responsible for all Fees incurred through the use of Your account.
5.8 If Your Account has a Contract period, once the Contract period has expired, You may continue to purchase the Account on a month-by-month basis.
5.9 If You provide a credit card or direct debit authority, it will be debited upon renewal unless You instruct otherwise. 14 days (2 weeks) notice is required if You do not want a payment to be charged against an existing credit card or direct debit authority to allow Pleiades Design enough time to take action to prevent the transaction.
5.10 Any unpaid monies owing to Pleiades Design may be referred to a collection agency where applicable.
5.11 Any Defined Abuse that causes significant network issues to Pleiades Design may result in charges to Yourself for Pleiades Design’s time and other costs incurred by Us as a result of the abuse.
5.12 Unless otherwise stated, Invoices may be paid by Cash, Cheque, Credit Card, or at a General Post Office through the issuance of a Cashiers Check or Money Order.
5.13 Pleiades Design will bill the customer for costs incurred due to any returned/un-honored checks including but not limited to, bank fees, collection fees, and administrative time.
6.0 Suspension and Termination
6.1 Section 6.0 applies to all Accounts.
6.2 You may change or terminate Your Account at any time. The following Fees apply:
(i) If You Terminate Your Account and have pre-paid Fees for a set term, no refund is payable;
(ii) If You wish to change Your Account You will receive pro-rata credit for Fees pre-paid unless otherwise stated, less a handling Fee of $5.00; or
(iii) If Your Account has a fixed Contract period, Service cancellation within the Contract period will incur a Break Fee for the sum of $10.00.
6.3 Pleiades Design may initiate Termination of Your Hosted Services if any Payments Due are not paid to Pleiades Design by the due date. The following will occur:
(i) Your Hosting Services will be temporarily withdrawn until payment is received; and
(ii) If a Suspended Account remains unpaid after a reasonable period (30 days) as Pleiades Design may permit, the Account will be closed.
(iii) If a closed account is not re-opened files related to that account will be removed within 90 days of the account closure unless a request to have them removed sooner is received or server space constraints require it.
6.4 Pleiades Design may Suspend Your Internet Access for up to 48 hours while investigating any complaint of criminal behavior or Defined Abuse on Your part. Pleiades Design will monitor or limit the Internet Access as required by the lawful direction of a competent law enforcement official. Pleiades Design will not be fiscally liable for or issue a credit/refund for the downtime for this type of a suspension.
6.5 Pleiades Design may initiate Termination of Your Internet Access for any reason, which includes but is not limited to Defined Abuse and the following will occur:
(i) Pleiades Design will notify You at the time of Termination;
(ii) Pleiades Design will have the right to levy a reasonable Fee for any costs incurred as a result of the Defined Abuse.
6.6 Pleiades Design is not responsible for WebPages, email or other data lost as a result of Your Account being closed either by You or by Us.
7.0 Disputing
7.1 Section 7.0 applies to all Accounts.
7.2 If You are disputing any matter with the Hosting Services provided by Pleiades Design, You can make a formal complaint by following the procedure detailed in the Complaints Procedure section below.
7.3 If You dispute any Payments Due, You are required to pay any outstanding invoice, less the disputed amount, which will be extended while the dispute is being investigated. Pleiades Design will inform You of the results of the dispute.
7.4 If Pleiades Design is found to owe You compensation due to a dispute, Pleiades Design will pay You as defined by any arrangements made for payment regarding the dispute or if no arrangements are made, at or before 30 days from the time the dispute is settled in full.
8.0 Third Parties
8.1 Section 8.0 applies to all Accounts.
8.2 Third party carrier costs for call connection Fees from Your Internet connection to connect to, modify or otherwise use Pleiades Design provided Hosting Services are Your responsibility.
8.3 You are responsible for all connections allowing You to utilize Hosting Services provided by Pleiades Design and Pleiades Design will not be held liable and will not refund fees or issue credits for Your lack of access to Your Hosting Services through loss of Your internet access.
8.4. To the fullest extent permitted by law You release and indemnify Pleiades Design and its suppliers from all liability, loss, expenses, damages and costs incurred, (including liability from third party claims) arising from or in connection with any possible disruption or cancellations of phone line Services, and possible breaches of the Telecommunications (Customer Service Guarantee) Standard.
9.0 General Agreement
9.1 Section 9.1 applies to all Accounts.
9.2 You indemnify and agree to keep indemnified Pleiades Design from and against all actions, claims, suits, demands, liabilities, costs or expenses arising out of or in any way connected to Your use of the Internet Access and Hosting Services. This indemnity is a continuing obligation separate from Your other obligations under the Contract and will continue despite termination of the Contract for whatever reason.

Password Guidelines
Your password is the means by which You secure Your account from unauthorized usage. Your password is known to Pleiades Design and our staff for the sole reason of helping You with access problems and will not be disclosed to any person by Pleiades Design staff without Your consent. Please note that Your password is a shared secret with Pleiades Design, and it is in Your interests to change the password regularly. Pleiades Design recommends the use of the following password specifications to ensure security is maintained. If You are found to have a weak password (one that is easily crackable or guessable), Pleiades Design reserves the right to request Your password be changed or suspend access to Your account until the password security criteria have been met.
Your password should be at least 6 characters long and contain at least 1 uppercase letter, 1 lowercase letter, 1 number and 1 special symbol (e.g. @#$*!+?><) and should not repeat a common pattern or closely resemble any dictionary words.(e.g. 11aaAA!! Or D0gD0g). An example of a secure password is: a2!Bag
Complaints Procedure
If You wish to make a complaint about Pleiades Design, our Services or any associated matter, You may contact us by email, letter, and facsimile. We do not require complaints to be in writing unless they involve legal matters. Wherever possible, complaints will be dealt with promptly, and where applicable You will receive a response within 5 working days.
